1. GENERAL NOTICE

This Legal Notice governs your access to and use of Belle Robe Boutique's website, social media platforms, and any related services (collectively, the "Platform"). By accessing or using the Platform, or by placing an order with Belle Robe Boutique, you ("Customer") acknowledge that you have read, understood, and agree to be bound by the terms set forth in this Legal Notice, as well as Belle Robe Boutique's Exchange Policy and Shipping Policy, all of which are incorporated herein by reference. If you do not agree to these terms, you must discontinue use of the Platform immediately.

Belle Robe Boutique reserves the right to amend, update, or modify this Legal Notice at any time and without prior notice. Continued use of the Platform following any such modification constitutes the Customer's acceptance of the revised terms.

2. BUSINESS INFORMATION

Belle Robe Boutique is a lawfully operating retail business. All transactions conducted through Belle Robe Boutique's Platform are subject to the laws of the State in which the business is registered and the applicable laws of the United States of America.

3. PRODUCT INFORMATION & ACCURACY DISCLAIMER

Belle Robe Boutique makes every reasonable effort to ensure that product descriptions, sizing information, pricing, and imagery displayed on the Platform are accurate and up to date. However, Belle Robe Boutique does not warrant that product descriptions or any other content on the Platform is complete, reliable, current, or error-free.

The Customer expressly acknowledges and agrees to the following:

  • (a) Color Variance: Product colors displayed on the Platform are subject to variation depending on the Customer's device screen settings, resolution, and display calibration. Belle Robe Boutique does not guarantee that colors rendered on the Customer's device will accurately reflect the true color of the physical product.
  • (b) Sizing Disclaimer: Sizing may vary by brand, style, fabric, and manufacturer. Belle Robe Boutique strongly encourages Customers to consult the sizing guide provided on each product listing prior to purchase. Belle Robe Boutique shall not be held liable for fit-related dissatisfaction arising from the Customer's failure to review available sizing information.
  • (c) Product Availability: All products are offered subject to availability. Belle Robe Boutique reserves the right to discontinue, modify, or limit the availability of any product at any time without prior notice.
  • (d) Pricing: Belle Robe Boutique reserves the right to adjust pricing at any time and without prior notice. In the event of a pricing error, Belle Robe Boutique reserves the right to cancel any order placed at an incorrect price and shall notify the Customer promptly.

4. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BELLE ROBE BOUTIQUE, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

  • (a) THE PURCHASE, USE, OR INABILITY TO USE ANY PRODUCT SOLD BY BELLE ROBE BOUTIQUE;
  • (b) ANY ERRORS OR OMISSIONS IN PRODUCT DESCRIPTIONS, PRICING, OR IMAGERY ON THE PLATFORM;
  • (c) ANY DELAY, LOSS, OR DAMAGE OCCURRING DURING SHIPPING OR DELIVERY;
  • (d) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF THE CUSTOMER'S PERSONAL OR TRANSACTIONAL DATA; OR
  • (e) ANY OTHER MATTER RELATING TO THE PLATFORM OR BELLE ROBE BOUTIQUE'S SERVICES.

THE CUSTOMER'S SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH A PRODUCT OR SERVICE SHALL BE LIMITED TO A PRODUCT EXCHANGE OR STORE CREDIT, AS SET FORTH IN BELLE ROBE BOUTIQUE'S EXCHANGE POLICY.

IN NO EVENT SHALL BELLE ROBE BOUTIQUE'S TOTAL LIABILITY TO THE CUSTOMER EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

5. INTELLECTUAL PROPERTY

All content published on the Platform, including but not limited to text, graphics, logos, product photographs, videos, design elements, and branding materials (collectively, "Intellectual Property"), is the exclusive property of Belle Robe Boutique and is protected under applicable United States copyright, trademark, and intellectual property laws.

The Customer is strictly prohibited from:

  • (a) Reproducing, copying, distributing, or republishing any Intellectual Property without the prior written consent of Belle Robe Boutique;
  • (b) Using Belle Robe Boutique's name, logo, or branding in any manner that implies endorsement, affiliation, or sponsorship without express written authorization; or
  • (c) Using any content from the Platform for commercial purposes without prior written consent.

Any unauthorized use of Belle Robe Boutique's Intellectual Property may result in legal action.

6. THIRD-PARTY LINKS & SERVICES

The Platform may contain links to third-party websites, social media platforms, or service providers for the Customer's convenience. Belle Robe Boutique does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party platform. The Customer accesses third-party links at their own risk, and Belle Robe Boutique shall bear no liability for any damages or losses arising from such access.

7. NO WARRANTIES

BELLE ROBE BOUTIQUE PROVIDES ALL PRODUCTS AND SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BELLE ROBE BOUTIQUE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. INDEMNIFICATION

The Customer agrees to indemnify, defend, and hold harmless Belle Robe Boutique and its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the Customer's use of the Platform; (b) the Customer's breach of this Legal Notice or any other Belle Robe Boutique policy; or (c) the Customer's violation of any applicable law or regulation.

9. GOVERNING LAW & DISPUTE RESOLUTION

This Legal Notice and all transactions conducted with Belle Robe Boutique shall be governed by and construed in accordance with the laws of the State of Missouri, United States of America, without regard to its conflict of law provisions. Any dispute arising out of or relating to this Legal Notice or any purchase from Belle Robe Boutique that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Missouri.

10. SEVERABILITY

If any provision of this Legal Notice is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

11. ENTIRE AGREEMENT

This Legal Notice, together with Belle Robe Boutique's Exchange Policy and Shipping Policy, constitutes the entire agreement between Belle Robe Boutique and the Customer with respect to the subject matter herein and supersedes all prior communications, representations, or agreements, whether written or oral.
